Terms of Service

1. Acceptance of Terms

By downloading, installing, or using ICU Coach ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

These Terms constitute a legally binding agreement between you and ICU Coach (operated by Murat Aydın, "we", "us", "our").

2. Description of Service

ICU Coach is an AI-powered training assistant that provides:

• Personalized workout recommendations
• Recovery and readiness analysis
• Nutrition guidance
• Race performance predictions
• Training load monitoring
• Morning reports and health insights

The app integrates with Intervals.icu, AI providers (Google Gemini, OpenAI), and device health platforms (Apple HealthKit, Google Health Connect).

3. Training & Health Disclaimer

• Always consult a healthcare professional before starting or modifying a training program.
• If you experience pain, dizziness, or unusual symptoms during exercise, stop immediately and seek medical attention.
• Recovery recommendations are estimates based on physiological models, not medical prescriptions.
• AI-generated content may contain errors or inaccuracies. Use your own judgment alongside app recommendations.
• Nutrition advice is for informational purposes only and does not replace consultation with a qualified nutritionist or dietitian.

4. Eligibility & Requirements

• You must be at least 16 years old to use the app.
• An active Intervals.icu account connected via OAuth authorization is required for full functionality.
• For AI features: Either your own OpenAI/Gemini API key, or use of the Cloud AI option, or a paid subscription is required.
• A demo mode is available for exploring the app without any accounts or keys.

5. Subscriptions & Payments

5.1 Free Trial

New users receive a 10-day free trial with limited AI feature access (up to 10 AI requests per day). No payment information is required for the trial.

5.2 Subscription Plans

ICU Coach offers the following subscription tiers:

• Athlete BYOK (Bring Your Own Key): Use your own AI API keys. Available as monthly or yearly subscription.
• Athlete Cloud: Use our Cloud AI backend without needing API keys. Available as monthly or yearly subscription.
• Coach Plans: Multi-athlete management with Starter (5 athletes), Pro (20 athletes), and Unlimited tiers. Available as monthly or yearly, in both BYOK and Cloud variants.

Current pricing is displayed on the subscription screen within the app and on the respective app store listing.

5.3 Auto-Renewal

All subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period.

5.4 Cancellation

• You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
• Cancellation takes effect at the end of the current billing period — you will retain access until then.
• No partial refunds are provided for unused portions of a subscription period.

5.5 Refunds

Refund requests are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies. We do not process refunds directly.

5.6 Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes in advance, and the new price will apply at the next renewal period. Continued use after a price change constitutes acceptance.

6. User Responsibilities

• You are responsible for the security of your API keys and account credentials.
• You agree to use the app only for its intended purpose (personal training guidance).
• You agree not to reverse-engineer, decompile, modify, or redistribute the app or its components.
• You agree not to use the app to generate content that violates any laws or third-party rights.
• AI API usage costs (OpenAI, Gemini) when using your own keys are solely your responsibility.
• You are responsible for ensuring the accuracy of the profile information you provide (age, weight, thresholds).

7. Intellectual Property

The app, including its source code, design, UI/UX, algorithms, AI prompts, recovery models, and documentation, is the intellectual property of ICU Coach. All rights reserved.

AI-generated workout plans and reports created for you through the app are yours to use for personal purposes. However, the underlying prompt engineering and system architecture remain our intellectual property.

8. Third-Party Services

The app relies on third-party services that have their own terms:

• Intervals.icu: Subject to Intervals.icu's terms of service and API usage policies, including authorized wellness data sync when Health Sync is enabled.
• OpenAI / Google Gemini: Subject to respective AI provider terms when using your own API keys.
• Apple App Store / Google Play Store: Subject to platform terms for purchases and subscriptions.
• RevenueCat: Processes subscription data according to its privacy and data handling policies.

We are not responsible for the availability, accuracy, or policies of third-party services.

9. Limitation of Liability

ICU Coach is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, we are not liable for:

• Injuries or health issues resulting from following app recommendations
• Inaccurate, incomplete, or misleading AI-generated content
• Data loss, corruption, or service interruptions
• Third-party service availability or downtime (Intervals.icu, OpenAI, Gemini, Sentry, RevenueCat)
• Unauthorized access to your API keys or data due to your device being compromised
• Any indirect, incidental, special, consequential, or punitive damages

Our total liability to you for any claims arising from or related to the app shall not exceed the amount you paid for the app in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless ICU Coach and its developer from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of the app
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any claim by a third party related to your use of the app

11. Termination

• You may stop using the app at any time by uninstalling it and cancelling any active subscription.
• We reserve the right to suspend or terminate your access to the app if you violate these Terms.
• We reserve the right to modify, suspend, or discontinue the service (or any part of it) at any time, with reasonable notice when possible.
• Upon termination, your right to use the app ceases immediately. Data stored locally on your device remains under your control.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the use of the app shall be subject to the exclusive jurisdiction of the courts of Istanbul, Türkiye.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through an in-app notice. The updated Terms will indicate a new "Last updated" date. Continued use of the app after changes constitutes acceptance of the new Terms.
